Legal Timeframe: While "as soon as practicable" is the general rule, delaying this report without good cause can jeopardize your claim. The employer has a corresponding duty under the Act to notify the Director-General of the WCF within a prescribed time after receiving your report.
Your health is paramount, and medical evidence is the bedrock of your compensation claim. Consult a Doctor Immediately: Seek treatment from a qualified medical practitioner. Specify It's Work-Related: Clearly inform the doctor that your injury or illness is work-related. This ensures the medical report reflects the cause. Medical Report: The medical practitioner will issue a medical report detailing the nature and extent of your injury or disease, the treatment given, and the period of incapacity. This document is critical. Follow Doctor's Orders: Adhere strictly to the prescribed treatment plan. Failure to do so could be used to argue that you contributed to the severity of your condition.
Once you report the incident, your employer is legally obligated to take the next steps with the WCF. Employer's Duty: The employer must notify the Director-General of the WCF of the accident or disease within the prescribed timeframe (typically seven days for an accident and fourteen days for a disease) using the prescribed forms (e.g., WCC-1). Your Right to Know: You have a right to know that this notification has been filed. You can request confirmation from your employer. Employer Failure: If your employer fails to notify the WCF, you or your representative (e.g., a trade union or lawyer) can file the notice directly with the Director-General.
